Court of referees

Today court proceedings may take a lot of time and effort, due to the fact that Ukrainian courts are filled with monotonous disputes. However to free up courts of arbitration and courts of general jurisdiction our country has shifted the system to fit the world standards — a substantial part of disputes were transferred to courts of referees.

Court of referees represents a non-government legal mechanism for handling civil and corporate disputes, at the same time court of referees is a registered business, which operates by public organizations (chambers of commerce and industry and stock exchange).

Court of referees handles disputes between two counterparties only based on the voluntary mutual agreement of both parties. The court of referees may handle the dispute which is already in action as well as the disputes which may arise in the future while carrying out certain obligations. In this case the dispute may be brought to court of referees through incorporation in the contract of a special stipulation about court of referees, and an additional agreement about bringing the dispute to the court of referees.

Property or commercial disputes, claims of the businessmen, tax or land disputes as well as disputes with counterparties from abroad are handled by the arbitration court. Its jurisdiction includes litigation related to commercial activities, as well as handling other economical disputes.

As a rule, arbitration court suggests collective handling of the case with participation of three judges. The main demand during such proceeding presumes actions of the judge to remain within boundaries of the procedural law, this point having the principal meaning while violation of the procedural regulations in a number of cases represents an unconditional reason for a decision of the arbitration court to be repealed.
